What Types of Damages Are Available in Tennessee Car Accident Injury Cases?

Posted on in Motor Vehicle Accidents

campbell county car crash lawyerEverything can change in the blink of an eye. One minute, you are sitting in traffic, waiting for the light to turn green, the next minute, you are being thrown forward because the vehicle behind you rear-ended your car. Though it may have only seemed like a minor shock in the beginning, a car accident like that can end up leaving you with chronic pain in the neck and shoulders, broken bones, or even a concussion, depending on the severity of the accident. If you are injured in a car accident, you may be able to get financial compensation from the person who caused it.

Compensation for a Personal Injury

If you have been injured because another person acted in a negligent manner, you may be able to claim compensation for your injuries from that person, or more likely, the person’s car insurance company. Some of the most common types of damages that are claimed in personal injury lawsuits include:

  • Economic damages - Economic damages are intended to compensate you for the monetary loss that you experience as a result of your injuries. These damages are those that are directly related to your incident, such as medical costs, lost wages, lost earning capacity, and the cost of any damage that occured to your property, such as your vehicle or things inside of your vehicle.

  • Non-economic damages - These damages are those that are meant to compensate you for losses that are not monetary. The most common types of noneconomic damages are pain and suffering, mental anguish, and loss of companionship.

  • Punitive Damages - These damages are awarded as a punishment to the at-fault party. Punitive damages exist only in cases in which the liable party’s actions were particularly malicious or wilfully reckless.

Does Tennessee Limit the Amount of Injury Awards?

Even though all of these types of damages are available to you after you have suffered an injury, some states limit the amount you can claim for compensation. In Tennessee, economic damages do not have a monetary cap, but non-economic damages do. You cannot claim an award of more than $750,000 in non-economic damages, unless you suffered a “catastrophic loss or injury,” in which circumstance, you can claim up to $1 million in non-economic damages. Under Tennessee law, a catastrophic injury or loss is defined as:

  • A spinal cord injury that renders a person paraplegic or quadriplegic

  • Amputation of both hands, both feet, or a hand and a foot

  • Third-degree burns that cover 40 percent or more of the body, or up to 40 percent of the face

  • Wrongful death of a parent who had a minor child
